Neil Gormley Victory in Leeco Mines Case

Photo: PROGRESS: Earthjustice attorneys and our allies scored a small, but potentially important victory when the court sided with us and temporarily halted a proposed mountaintop removal mine in Kentucky until a final decision could be reached. http://ow.ly/t5MN2

Although that represents some good news, we are still pressing the Army Corps of Engineers to consider health impacts before they issue permits for these destructive projects. Coal production, tax revenue, energy security - all of these so-called benefits are counted, but notice anything missing? NO mention of human health impacts. That is a glaring omission.

Getting It Right for the Arctic Ocean

Walruses in the Chukchi Sea. (USGS)

January 22, 2014, earthjustice.org | “A court gave the Arctic great news today. The Court of Appeals for the Ninth Circuit ruled that the Department of the Interior violated the law when it sold offshore oil and gas leases in the Chukchi Sea off the coast of Alaska, including the leases on which Royal Dutch Shell wants to drill. This is the second time a court has ruled against the Department’s decision to open this remarkable sea to offshore drilling.”

VICTORY! Shell Oil won’t be happy with the latest setback to its plan to drill in the Arctic. The Ninth Circuit Court of Appeals has ruled that the Dept. of Interior violated the law when it sold offshore oil and gas leases in the Chukchi Sea to oil companies like Shell. http://ow.ly/sR6iM

Dept. of Interior is now forced to revise its environmental analysis and reconsider the controversial leases. The Chukchi, part of the Arctic Ocean, is prime habitat for polar bears, beluga whales, walruses and seals. It is also home to vibrant Alaska Native Communities who depend on the ocean for their subsistence.

Oil production in Greenland? Maybe not.

January 20, 2014, www.enn.com | “None of the oil companies that have a license to drill in the seas surrounding Greenland have applied for one in 2014, according to the environment NGO Greenpeace.
Oil companies that want to drill in Greenland will have to apply before 1 February, but according to Greenland’s Mining Agency, no applications have been received thus far.”

Though oil has never been found in Greenland, the deposits are estimated to be huge, especially in the northeastern and western parts of the country. However, oil drilling is complicated due to icebergs, rough weather, drifting ice — and Greenpeace!

Exxon to Face Criminal Charges for 50,000+ Gallon Fracking Wastewater Spill

January 3, 2014, ecowatch.com | “Exxon Mobil Corp. subsidiary XTO Energy will have to face criminal charges for allegedly dumping tens of thousands of gallons of fracking waste at a Marcellus Shale drilling site in 2010, according to a Pennsylvania judge’s ruling on Thursday.  Following a preliminary hearing, Magisterial District Judge James G. Carn decided that all eight charges against Exxon—including violations of both the state Clean Streams Law and the Solid Waste Management Act—will be “held for court,” meaning there is enough evidence to take the fossil fuel giant to trial over felony offenses.”

Massachusetts Legislature moves on fracking moratorium

December 2, 2013, www.enn.com | “The Massachusetts Legislature’s Joint Committee on Environment, Natural Resources and Agriculture has approved a 10-year moratorium on hydraulic fracturing — better known as fracking. The committee’s approval of a bill introduced by Reps. Peter Kocot, D-Northampton, and Denise Provost, D-Somerville, came after Environment Massachusetts and its allies presented the committee with documented cases of water contamination, illness and other damage from fracking operations elsewhere.”
